Introduction
Welcome to Muse Pilates Studio (“Muse”). At Muse, we believe that Pilates should be fun, challenging and safe. While we don’t take ourselves too seriously, we do take our Terms and Conditions seriously.

Safety:

Physical exercise conducted at Muse in all its form (with or without the use of equipment) is a strenuous physical activity. Prior to beginning any physical exercise regime, routine or program (with or without equipment) you should consult with your doctor or health care practitioner to ensure that you are aware of any current health or physical restrictions or any other restrictions that may be appropriate for you.
You must notify your instructor if you have any pre-existing injuries or medical conditions which may impact your ability to perform an exercise.
Owners and/or Instructor’s reserve their right to restrict clients to a particular class type for safety reasons; and Owners and/or Instructors reserve their right to turn clients away if they do not have the correct medical clearance.
During your Pilates class you should not feel any pain or discomfort, if you feel pain or discomfort you should immediately stop the exercise. You should then seek medical assistance.
Muse instructors or staff cannot provide medical advice or diagnosis. Information provided by your instructor should not be construed as medical advice.
By undertaking any exercise programme at a Muse Pilates Studio or in connection with Muse Pilates Studio you acknowledge that you do so at your own risk and that Muse Instructors, Muse Staff and Directors of Muse will not be liable for any personal injury, loss or liability whatsoever nature arising as a result of, or in connection with, your undertaking of any such exercise programme or following advice contained on this website or given by our instructors.

Pregnancy:

Our classes are safe for women to attend up to 12 weeks of pregnancy. From 12 weeks, we will require a certificate from your treating practitioner to confirm that you can attend group reformer classes.

Payment + Bookings:

Our current prices are displayed on our website and the MindBody App. From time to time our prices may change and these will be reflected on our website and the MindBody App.
Our prices may vary between studios.
Bookings are made online through the MindBody booking system on the website or app. Your Muse account via the MindBody App will be governed by these terms and conditions, our Website Terms of Use, and our Privacy Policy.
Payment must be made upon booking, there are NO exceptions. To book into a class you must either have pre-purchased classes or have a valid membership in your account or pay at the time of booking.
Classes are not transferable to another individual and cannot under any circumstances be used by another person. NOTE: If someone other than the person booked into the class arrives to use the class, they will be turned away from the class – or asked to purchase their own classes. You will not receive a refund for your class if this occurs and we reserve the right to cancel your membership in this case.

Attendance + Conditions of Entry:

Out of consideration for other clients and the instructor and also for your own safety, the warm-up is an important aspect of each class. Please be aware that if you are more than 2 minutes late for a class, the instructor may not allow you to participate in the class. This is determined at the Instructor’s sole discretion.
You are required to treat all persons and Muse Pilates equipment with care and respect.
Please refrain from leaving the class prior to the conclusion of the class.
Unless absolutely necessary for you to be available please turn off your mobile phone during your workout.
Muse Pilates Studio reserves the right to refuse entry or eject any person or client from our studios for any reasonable reason including but not limited to anti-social behaviour, aggressive or offensive behaviour or any other reason that puts any other person at risk.
You must be at least 16 years of age to attend classes at Muse Pilates Studio. Children younger than this age are not permitted in our studio and are not to be left in the studio or waiting area while you attend classes.

Muse Pilates Studio is not responsible in any way for the safekeeping of your belongings that bring into the studio.

Class Schedules:

Class schedules may differ between studios and are subject to change without notice. However, you will be notified of any permanent change to the timetable.
We reserve our right to change our operating hours at our studios at any time.

Cancellations:

All classes need to be booked through the MindBody app or Muse Pilates Hamilton website (www.musepilateshamilton.com), online bookings opens 14 days prior to class.
We appreciate that you may need to cancel your class due to unforeseeable circumstances, if you cancel your class this must be done on the MindBody app or our Muse Pilates Hamilton website at least 9 hours prior to your class commencing and there will be no penalty fee. If you fail to cancel your class or fail to attend your class without providing nine hour’s notice, you will:
Forfeit the class for those on a Silver or Gold member or class pack holders;
Be charged $15.00 ‘late cancellation/no show’ fee for unlimited membership holders.
Private classes have a strict 24-hour cancellation policy.
Instructors and classes are subject to change without notice. Muse Pilates Studio Hamilton reserves the right to cancel classes if deemed necessary.
Muse Pilates Studio Hamilton has a strict cancellation policy and no exceptions will be made to this Policy, please see your Membership Agreement Terms and Conditions on our website.

Class Packs:

Class Packs and Private Classes are valid for three months and are activated on the date of purchase through the MindBody system, with the exception of the 50 Class pack which is valid for six months from the date of purchase. Class Packs are non-refundable and are not transferable between individuals and CANNOT be extended unless you are injured, in which case we will request a medical certificate. Extensions due to medical reasons must be requested before the expiry date. Class packs cannot be shared as all class packs are for individual use only.

Upfront Unlimited Memberships:

Memberships are valid for 365 days.
A valid credit or debit card must be kept on the MindBody system at all times, otherwise the membership will be cancelled without compensation.
As with all Muse Unlimited Memberships, a $15.00 ‘late cancelation /no show’ fee shall be charged for any late cancellations (within 9 hours of the scheduled class) or no shows.
There are no refunds, exchanges or suspensions on our upfront passes.

Memberships:

Weekly Direct Debits are valid for 1 week (7 days) and are activated on your chosen direct debit start date, automatically renewing every week. Weekly Direct Debits are non-refundable and are not transferable between individuals and CANNOT be extended unless you are injured, in which case we will request a medical certificate. Extensions due to medical reasons must be requested before the expiry date. Weekly Direct Debits can be cancelled at any time after the minimum term by giving 30 days’ notice via email to Muse. Payment will be automatically deducted from your nominated credit card each week (on your chosen day). If payment defaults you will be charged a default fee of $14.90, for each time there is a default in payment. Where there are two or more defaults, your membership may be terminated, with prior missed payments still payable. For Silver, Gold and Platinum Memberships, your minimum term agreement is for 16 weeks. This will be paid in weekly instalments. You may cancel at any time, giving 30 days’ notice after the initial 16-week period. Notice of cancellation must be sent via email to Muse. For Foundation Memberships your agreement is ongoing and the fee will be paid in weekly instalments. You may cancel at any time, giving 30 days’ notice. Notice of cancellation must be sent via email to Muse. Weekly memberships can be put on hold (or suspended) for up to 8 weeks (56 days) annually. 7 days’ notice must be given by emailing the hold dates to Muse. You must give 7 days’ notice and the hold must be in 7-day increments. Please note that we are not able to back date any membership hold.
For, Silver and Gold Memberships, any classes you book over your membership limit (Silver – two classes per week and Gold – three classes per week) you will be charged in the amount of $20 per class that you book or attend that is over your Gold or Silver membership limit. If you do not book or attend your maximum limit of Gold or Silver memberships classes during the allocated week, any unused classes will not rollover.

Special Offers:

Introductory Offer: You can only purchase the Introductory offer once, if you purchase this offer more than once, you agree to be charged the per class rate for each additional class you do. The Introductory Offer is non-refundable nor transferable and will activate from the date of purchase.
All other classes and class packs are non-refundable or transferable and will be valid for 3 months only, with the exception of the 50 class pack which is valid for 6 months.
Gift cards are non-refundable or transferable and are valid for 3 months only. To redeem gift cards, you book using your voucher through the Muse website or app.

Wait lists:

If a class you wish to attend is fully booked, please sign up for the waiting list. Due to our nine-hour cancellation policy there is likely to be a place in the class become available to you if you are on the waiting list. Should a place become available you will then receive either an email or text from us confirming if you have been moved from the waitlist to the class. If you are on the waitlist, the nine-hour cancellation policy also applies to you. If you know that you cannot attend a class that you are waitlisted for, it is your responsibility to remove yourself from the waitlist. You need to ensure that you turn on email notifications in your MindBody account in order to receive an email confirming that you have been moved from Waitlist into the class. If you don’t wish to receive emails, you must ensure that you switch on mobile notifications in your MindBody account to receive confirmation that you have been moved from Waitlist into the class. If you do not wish to receive emails or notifications, it is your responsibility to ensure that you log in to the MindBody system to check if you have been moved from Waitlist into the class. Should you fail to attend the class due to not having your notifications switched on or set up properly in MindBody or due to not checking your schedule in MindBody, you will forfeit that class or if you are on an unlimited membership, you will be charged a $15.00 “no show’ fee according to the cancellation policy.

Re-opening Membership:

The minimum term of the contract is 12 months and there are no holds/suspensions available for the duration of the contract. You agree to be charged $14.90 for any time there is a default in your weekly payment and agree that a debt collector will be engaged should you not pay your membership fees in full. You can cancel at any time after the 12-month minimum term with 30 days’ notice.

The payment will be billed weekly via debit or credit card. No refunds, transfers or extensions are available.

You are agreeing to commit to 12 months, after 12 months you can cancel your membership anytime providing 30 days’ notice.

Personal Agreement:

Upon booking into a Muse Pilates Studio class, you agree to the following statement:

‘Muse Pilates Studio activities, whilst care is taken, are not without risk which you accept, and in turn I indemnify in full, Muse Pilates Studio, it’s Directors, employees, contractors, instructors, agents and nominees against all liabilities, damages and costs arising from Muse Pilates Studio activities. This includes but is not limited to, liabilities arising from any cause such as negligence, contract, statute including the Civil Liability Act 2002, tortious or common law for any injury, death, loss, property damage or expense arising out of or sustained to me or I cause, in the course of my participation in the activities and programs offered by Muse Pilates Studio, both on and off of the Muse Pilates Studio’s premises or in relation to any activities, including to any party. I agree that Muse Pilates Studio is not responsible in the event of loss, damage, unauthorised use, theft or injury resulting from and to any personal property that I bring onto or undertake on the premises. I recognise that this Agreement and Release and Waiver is a legal instrument and that it is intended to be as broad and inclusive as permitted by Australian law. Muse Pilates Studio’s liability in the aggregate is the refund of the fees paid for the Muse Pilates Studio activity. I recognise that by booking into a class I agree to the above terms and conditions and I am waiving certain legal rights, including the right to sue and I do so of my own free will and assume all aspects of the risks involved.’

Definitions

“Muse Pilates Studio” or “Muse” consists of A.C.N 644 590 956 Pty Ltd.

Payment + Bookings + Attendance

5. Classes are not transferable to another individual and cannot under any circumstances be used by another person. Class Packs are non-refundable and are not transferable between individuals and CANNOT be extended unless you are injured, in which case we will request a medical certificate. Extensions due to medical reasons must be requested before the expiry date. Class packs cannot be shared as all class packs are for individual use only.

Upfront Unlimited Memberships

Memberships are valid for 365 days.

A valid credit or debit card must be kept on the Wellness Living system at all times, otherwise the membership will be cancelled without compensation. 

As with all Muse Unlimited Memberships, a $25 fee shall be charged for any late cancellations (within 9 hours of the scheduled class) or no shows. 

There are no refunds, exchanges or suspensions on our upfront passes. 

Weekly Memberships

5. For Memberships (with the exception of the Foundation Membership) your agreement is scheduled for 16 weeks . This will be paid in weekly instalments. You may cancel at any time, giving 30 days notice after the initial 16-week period. Notice of cancellation must be sent via email to hello@musepilatesstudio.com.

6. For Foundation Memberships your agreement is ongoing and the fee will be paid in weekly instalments. You may cancel at any time, giving 30 days notice. Notice of cancellation must be sent via email to hello@musepilatesstudio.com.

7. Weekly memberships can be put on hold (or suspended) for up to 8 weeks (56 days) annually. 7 days’ notice must be given by emailing the hold dates to hello@musepilatesstudio.com. You must give 7 days’ notice and the hold must be in 7-day increments. Please note that we are not able to back date any membership hold.

Special Offers

1. Introductory Offer: You can only purchase the Introductory offer once, if you have been found to purchase this offer more than once, you agree to be charged the per class rate for each additional class you do. The Introductory Offer is non-refundable nor transferable and will activate from the date of purchase. 

2. All other classes and class packs are non-refundable nor transferable and will be valid for 3 months only.

3. Gift cards are non-refundable nor transferable and are valid for 3 months only. To redeem gift cards you book using your voucher through the Wellness Living website or app.

Wait lists

If a class you wish to attend is fully booked, please sign up for the waiting list. Due to our 9hr cancellation policy there is movement in the classes. Should a place become available then you will receive an email from us confirming if you have been moved from the waitlist to the class. The 9-hour cancellation policy applies to those who have put themselves on the waitlist for a class also. If you know you will not be able to make a class that you have waitlisted yourself on, it is your responsibility to remove yourself from the waitlist. You need to ensure that you turn on email notifications in your Wellness Living account in order to receive an email confirming that you have been moved from Waitlist into the class. If you don’t wish to receive emails, you must ensure that you switch on app notifications in your Wellness Living account to receive a notification confirming that you have been moved from Waitlist into the class. If you do not wish to receive emails from Wellness Living, it is your responsibility to ensure that you log in to the Wellness Living system to check if you have been moved from Waitlist into the class. Should you miss you the class due to not having your notifications switched on or set up properly in Wellness Living or due to not checking your schedule in Wellness Living, you will forfeit that class or if you are on an unlimited membership, you will be charged a $25 fee according to the cancellation policy. 

Cancellations

1. Cancellations/Rescheduling classes need to be made more than 9 hours prior to your class beginning. We do understand that sometimes unforeseeable circumstances can arise, but we have to be strict, consistent and fair with all clients, therefore, NO exceptions will be made to this policy. If you make a booking and fail to attend, without providing at least 9 hours’ notice of your cancellation by cancelling or rescheduling your class in Wellness Living, you will incur a lost of class and if you are on an unlimited membership you will be charged $25.

2. Private classes have a strict 24 hour cancellation policy.

3. Instructors and classes are subject to change without notice. Muse Pilates Studio reserves the right to cancel classes if deemed necessary.

4. Class sizes are limited to 12 and must be pre-booked online. Online booking opens 7 days prior to class. Online booking closes 60 minutes before class.

The Payment Policy

Payment must be made upon booking, there are NO exceptions. To book into a class you must either have credits in your account or pay at the time of booking, or be on a current membership with the outstanding payments.

Age Restrictions

You must be at least 16 years of age to attend classes at Muse Pilates Studio. Children younger than this age are not permitted in our studio and are not to be left in the studio or waiting area while you attend classes.

Pregnancies + Injuries

You must inform the Instructor if you are pregnant or have any injuries. 

Illness 

If you meet any of the following criteria, you must refrain from entering the studio: 

  • feeling unwell
  • cold & flu symptoms 
  • shortness of breath 
  • difficulty breathing 
  • cough 
  • other respiratory symptoms 
  • Close contact with anyone with these symptoms or with a confirmed case of COVID-19
  • Recently travelled overseas 

Re-opening Membership:

6. Muse Re-Opening memberships cannot be put on hold (or suspended).
